合同翻譯的要求注意事項及其案例

鑒于現(xiàn)在對外交流事例逐漸增多,英文合同特別是經(jīng)濟(jì)合同的翻譯愈顯重要,若譯文不準(zhǔn)確或不嚴(yán)謹(jǐn),勢必會引起不必要的經(jīng)濟(jì)糾紛.故今以一英文(經(jīng)濟(jì))合同寫作書籍為藍(lán)本,錄入一些有益文字,希望大家共同提高英文(經(jīng)濟(jì))合同的翻譯和寫作。

　　合同文件是合同雙方簽訂并必須遵守的法律文件,因此合同中的語言應(yīng)體現(xiàn)其權(quán)威性.英文合同用語的特點之一就表現(xiàn)在用詞上,即選擇那些法律用詞,以及正式用詞,使合同表達(dá)的意思準(zhǔn)確無誤,達(dá)到雙方對合同中使用的詞無可爭議的程度。

　　1.合同翻譯的注意事項

　　要翻譯好合同，我們必須首先了解合同本身的特點。合同屬法律文件，其條款內(nèi)容周密，語言精確，毫不含糊。歸納起來，合同有以下幾個特點：

　　1.1選詞具體

　　合同的目的是明確參與各方的權(quán)利、義務(wù)。用詞過于抽象，給人聯(lián)想的余地就大。為了避免造成理解上的誤區(qū)，用詞須具體。

　　1.2 用詞精當(dāng)

　　1.3表達(dá)縝密

　　合同是一種法律文本，往往一個限制性短語，甚至一個字都涉及到權(quán)利和義務(wù)。因此，為了使條款更準(zhǔn)確，往往使用很多限制詞語，句法結(jié)構(gòu)也顯得比較復(fù)雜。１）狀語限定。狀語可表時間、條件，因果，也可表方式，目的，從不同方面對合同各方權(quán)益進(jìn)行嚴(yán)格的限定，以確保意思準(zhǔn)確、不含糊。

　　2.合同翻譯實例：

　　用法:常用于法律文件、合同、協(xié)議書等正式文件的開頭語；在條款中需要強調(diào)時也可用。

　　語法：一般置于主語后,緊鄰主語.
